International law firm Eversheds LLP have filed a claim in London on behalf of Experience Hendrix LLC, the successor to the Jimi Hendrix Estate, and The Last Experience, Inc. against Times Newspapers Ltd for the publication of an alleged unauthorised Sunday Times covermount CD of Hendrix's performances at the Royal Albert Hall in 1969.
In September last year, The Sunday Times issued a covermount CD of Hendrix recordings, including performances of well-known Hendrix songs Purple Haze, Voodoo Chile and Foxy Lady.
The Claimants allege that Times Newspapers Ltd did not seek consent of either party, or anyone else authorised by them to give permission on their behalf, thus infringing their rights in the performances and copyrights in the recordings. Experience Hendrix originally sought to stop the distribution of the CD prior to its publication, but Times Newspapers Ltd refused to comply.
